Efektivitas Penegakan Hukum Terhadap Tindak Pidana Pungutan Liar Retribusi Sampah dalam Perspektif Hukum Administrasi Negara di Kota Pekanbaru

Abstract

Illegal levies (pungli) on waste management fees constitute a serious issue that disrupts the delivery of public services in Pekanbaru City. This study aims to analyze the effectiveness of law enforcement against the criminal offense of illegal levies on waste management fees from the perspective of State Administrative Law, as well as to identify hindering factors and efforts for its optimization. The method employed is normative juridical, utilizing statutory, conceptual, and case approaches. The results of the study indicate that law enforcement against illegal levies on waste management fees in Pekanbaru City has not operated optimally due to weak bureaucratic supervision, low sanctions imposed, and a lack of public participation. From the perspective of State Administrative Law, the practice of illegal levies violates the general principles of good governance (AUPB) as regulated in Law Number 30 of 2014 concerning Government Administration, while also potentially being qualified as a criminal act of corruption under Law Number 31 of 1999 in conjunction with Law Number 20 of 2001. Efforts to optimize law enforcement require the strengthening of supervisory institutions, consistency in applying administrative and criminal sanctions, and information technology-based bureaucratic reform to achieve clean and accountable governance.
